The judgment of dismissal entered on September 21, 1983, is vacated. A final judgment for the defendants is to enter now (Mass.R.Civ.P. 54[b], 365 Mass. 821), on counts 1, 2 and 4 of the complaint. The case shall stand for further proceedings on count 3 of the complaint.
