MEMORANDUM OPINION
The Court has before it appellant's November 12, 2009 motion to dismiss his appeal. In the motion, appellant states the parties have executed an agreement to forego levy and execution upon the judgment, and appellant has agreed to dismiss the appeal. We grant the motion and dismiss the appeal. See Tex. R. App. P. 42.1(a).
