Bernard A. STOREY, Petitioner(s) v. STATE of Florida, Respondent(s).


The Court, having considered that the Second District Court of Appeal dismissed the appeal after the State filed a motion to dismiss based on the defendant's deportation, grants the petition for writ of mandamus and directs the Second District Court of Appeal to rule on the merits of the appeal. Because we are confident that the district court will act in a manner consistent with this order, we withhold issuance of the writ.
