Billy STONE dba Stobil Enterprise and All Occupants, Appellant v. K CLARK PROPERTY MANAGEMENT LLC, Appellee

From the County Court At Law No. 10, Bexar County, Texas Trial Court No. 2020CV00366 Honorable J Frank Davis, Judge Presiding

ORDER

BETH WATKINS, JUSTICE.

On May 6, 2020, we issued an opinion and order dismissing this appeal for want of jurisdiction. Our plenary power over this matter expired on July 5, 2020, and on August 21, 2020, we issued our mandate.

On April 17, 2023, appellants filed a motion contending that the trial court violated our order and mandate. We denied appellants' motion on April 25, 2023. Appellants subsequently filed a "Motion Requesting a Corrective Order of the Court['s] 25 April 2023 Ruling and Writ of Enforcement of the Court's 2020 Mandate in the Interest of Justice and Law." In response, appellee filed a motion asking us to: (1) deny appellants' motion; and (2) enter a sanctions order against appellants.

Appellants' "Motion Requesting a Corrective Order of the Court['s] 25 April 2023 Ruling and Writ of Enforcement of the Court's 2020 Mandate in the Interest of Justice and Law" is DENIED. Appellee's motion for sanctions is also DENIED. Because we have already concluded we lack jurisdiction over this appeal and issued our mandate to that effect, we will not consider any further motions in this appeal. See, e.g., Tex. Ass'n of Bus. v. Tex. Air Control Bd., 852 S.W.2d 440, 443 (Tex. 1993) ("Subject matter jurisdiction is essential to the authority of a court to decide a case.").
