Stolberg v. Stolberg

Appellate Court of Illinois, First District
Feb 23, 1940
304 Ill. App. 258 (Ill. App. Ct. 1940)

Opinion

Gen. No. 40,932. (Abstract of Decision.)

Opinion filed February 23, 1940

HUSBAND AND WIFE, § 189separate maintenance, sufficiency of evidence. In action for separate maintenance, evidence did not show that plaintiff was living separate and apart without fault on her part, where parties were separated for more than two years and wife made no offer to return until a few weeks before trial, and offer could not be considered bona fide in view of remarks wife made about her husband, and letters of endearing nature she had written to another man.

See Callaghan's Illinois Digest, same topic and section number.

Appeal from Circuit Court of Cook county; Hon. J. PRYSTALSKI, presiding.

Affirmed. Heard in second division, first district, at October term, 1939.

Clarence W. Shaver, for appellant;

Sonnenschein Mitchell, for appellee;

Harry L. Mitchell, of counsel.
