TONJAH MICHELLE STEWART, Appellant v. BILLY WAYNE STEWART, Appellee

On Appeal from the 422nd Judicial District Court Kaufman County, Texas
Trial Court Cause No. 92793-422

ORDER

Before the Court is court reporter Donna R. Gehl's request for extension of time to file the reporter's record. She explains she has not received "satisfactory" payment of her fees and seeks to file the reporter's record ten days after "satisfactory" payment is made. The final judgment in this case was signed January 4, 2016. Accordingly, the record is not due until March 4, 2016.

Although the record is not yet due, Ms. Gehl is not responsible for filing the record until appellant has paid, or made satisfactory arrangements to pay, the reporter's fee or appellant has shown entitlement to appeal without prepayment of costs. See TEX. R. APP. P. 35.3(b). Accordingly, we ORDER appellant to provide, no later than March 4, 2016, written verification that she has paid, or made satisfactory arrangements to pay, the reporter's fee or is entitled to proceed without paying the fee. Once the requested verification is filed, the Court will set a new deadline for the filing of the record.

We caution appellant that failure to file the requested verification may result in the appeal being submitted without the reporter's record. See id. 37.3(c)(2)(A).
