Upon due consideration of the representations contained in petitioner's motion for continuance, filed April 12, 2023, it is

ORDERED that petitioner's motion is granted, this case is stricken for trial from the San Diego, California, trial session scheduled to begin on May 15, 2023, and is continued with jurisdiction retained by this Division of the Court. It is further

ORDERED that unless a proposed stipulated decision is submitted sooner, on or before June 12, 2023, the parties shall file a joint status report (or if that is not possible, then separate reports) stating the then current status of this case. If the next status report does not report settlement, the Court will consider returning the case to general docket to ensure it is included on a fall trial session calendar.
