Stern v. Stern

Appellate Division of the Supreme Court of New York, Second Department
Feb 14, 1950
276 App. Div. 973 (N.Y. App. Div. 1950)

Opinion

February 14, 1950.

In an uncontested action for divorce, judgment in favor of plaintiff and against defendant which, however, contained no provisions for support, was entered on October 24, 1933. More than twelve years thereafter, and on April 15, 1946, defendant died. Thereafter, plaintiff, after procuring the substitution of the administratrix of the defendant's estate as defendant in this action, made application in this action for modification of the judgment of divorce so as to provide for alimony nunc pro tunc, as well as support for a period of time of about five years preceding the date of the entry of the judgment. The application was denied by the order presently appealed from. Order affirmed, without costs. No opinion. Carswell, Acting P.J., Johnston, Sneed, Wenzel and MacCrate, JJ., concur. [See post, p. 1083.]
