District Court of Appeal of Florida, Fourth District
May 10, 1995
653 So. 2d 1148 (Fla. Dist. Ct. App. 1995)

Opinion

No. 95-0280.

May 10, 1995.

Appeal of order denying rule 3.850 motion from the Circuit Court for Broward County; Barry E. Goldstein, Judge.

Sheldon R. Zilbert of Law Offices of Sheldon R. Zilbert, Miami, for appellant.

No brief filed for appellee.

We affirm the trial court's denial of appellant's motion for relief pursuant to Florida Rule of Criminal Procedure 3.850, as the motion was not filed within the two year limitation set forth in section (b) of the rule, nor has appellant set forth any valid justification for such untimeliness.

STONE, POLEN and PARIENTE, JJ., concur.
