Appellant having moved for an extension of time to file and serve a reply brief on the appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Onondaga on November 18, 2010,

Now, upon reading and filing the affidavit of John A. Cirando, Esq., sworn to May 11, 2012, the notice of motion with proof of service thereof, and the affidavit of Jeffrey J. White, Esq., sworn to May 22, 2012, and due deliberation having been had thereon,
