State v. Woods

Supreme Court of Louisiana
Mar 25, 1983
427 So. 2d 842 (La. 1983)

Opinion

No. 82-KA-1517.

January 28, 1983. Rehearing Denied March 25, 1983.

Appeal from the 3rd Judicial District Court, Parish of Lincoln; O.L. Waltman, Jr., Judge.

William J. Guste, Jr., Atty. Gen., Barbara Rutledge, Asst. Atty. Gen., Tommy Adkins, Dist. Atty., for plaintiff-appellee.

Thos. W. Davenport, Jr., Davenport, Files Kelly, Monroe, for defendant-appellant.

Conviction affirmed; sentenced reversed; case remanded for resentencing. The sentence is apparently severe, and there was no compliance with La.C.Cr.P. art. 894.1.

WATSON, J., concurs believing the fine, in particular, is excessive.

BLANCHE and LEMMON, JJ., would grant a rehearing.
