STATE OF LOUISIANA v. WENDELL WESLEY


In Re: Wendell Wesley, applying for supervisory writs, 18th Judicial District Court, Parish of Iberville, No. 26607. BEFORE: WHIPPLE, C.J., McCLENDON, AND HIGGINBOTHAM, JJ.

WRIT GRANTED. The trial court's ruling on relator's application for postconviction relief is vacated, and the matter is remanded to the trial court for consideration of the merits of relator's claims raised in the application, particularly in light of this Court's ruling in State v. Wesley, 2010-2066 (La. App. 1st Cir. 9/14/11), 77 So.3d 55, writ denied, 2011-2311 (La. 9/21/12), 98 So.3d 322, wherein this Court addressed relator's sole assignment of error regarding the trial court's denial of the motion to suppress statements.
