State v. T.W

District Court of Appeal of Florida, Fourth District
Feb 8, 1989
537 So. 2d 718 (Fla. Dist. Ct. App. 1989)

Opinion

No. 88-1094.

February 8, 1989.

Appeal from the Circuit Court for Broward County; John A. Miller, Judge.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Celia A. Terenzio, Asst. Atty. Gen., West Palm Beach, for appellant.

Richard L. Jorandby, Public Defender, and Susan D. Cline, Asst. Public Defender, West Palm Beach, for appellee.

We reverse on the authority of State v. Nelson, 320 So.2d 835 (Fla. 2d DCA 1975). The record reveals that appellee's counsel verbally acquiesced in open court to the court's setting of appellant's trial date beyond the time for speedy trial.

LETTS, DELL and GUNTHER, JJ., concur.
