Case No. 6D23-432

02-24-2023

STATE of Florida, Appellant, v. Stephanie TOMPKINS, Appellee.

Ashley Moody, Attorney General, Tallahassee, and Cerese Crawford Taylor, Assistant Attorney General, Tampa, for Appellant. Stephen M. Grogoza, Naples, for Appellee.

Ashley Moody, Attorney General, Tallahassee, and Cerese Crawford Taylor, Assistant Attorney General, Tampa, for Appellant.

Stephen M. Grogoza, Naples, for Appellee.

STARGEL, J.

In this companion case to State v. Hickman , No. 6D23-431, 363 So.3d 217 (Fla. 6th DCA Feb. 17, 2023), the State challenges an order granting Stephanie Tompkins’ motion to suppress. Tompkins and Hickman were co-defendants who each filed nearly identical motions to suppress narcotics seized following an encounter with law enforcement. A joint hearing was held as to their respective motions, and the trial court issued a joint ruling granting the motions to suppress. We reverse and remand for further proceedings consistent with this Court's opinion in Hickman .

This case was transferred from the Second District Court of Appeal to this Court on January 1, 2023.

REVERSED and REMANDED for further proceedings.

COHEN and MIZE, JJ., concur.
