From the County Court at Law No 2, Webb County, Texas Trial Court No. 2022CRB000731L1 Honorable Leticia Martinez, Judge Presiding
ORDER
LUZ ELENA D. CHAPA, JUSTICE
The State's brief was originally due July 5, 2023; however, our clerk's office granted an extension of time to file the brief until August 4, 2023. The State did not file its brief. After our clerk's office notified the State it's brief was late, the State filed a motion requesting an additional thirty-day extension explaining it was dealing with the unexpected departure of its primary appellate attorney.
We grant in part the motion and order the State to file its brief by September 22, 2023. Counsel is advised that no further extensions of time will be granted absent a motion, filed by the date the brief is due, that (1) demonstrates extraordinary circumstances justifying further delay, (2) advises the court of the efforts counsel has expended in preparing the brief, and (3) provides the court reasonable assurance that the brief will be completed and filed by the requested extended deadline. The court does not generally consider a heavy work schedule to be an extraordinary circumstance.
