Gentlemen:

The Court has received a Motion for Modification of Sentence. Paragraph 1 of the Motion indicates the Motion is filed pursuant to 11 Del. C. § 4217. As I understand it, an application under 11 Del. C. § 4217 can only be filed by the Department of Corrections. This application does not appear to have been filed by the Department of Corrections. Consequently, the application must be DENIED. IT IS SO ORDERED.
