STATE OF LOUISIANA v. REGGIE PATRICK THIBODEAUX


In Re: Reggie Patrick Thibodeaux, applying for supervisory writs, 32nd Judicial District Court, Parish of Terrebonne, Nos. 737,860 and 740,222. BEFORE: WHIPPLE, C.J., GUIDRY AND McCLENDON, JJ.

WRIT GRANTED IN PART AND DENIED IN PART. The district court's ruling denying relator's motion to suppress is vacated, and this matter is remanded to the district court for the purpose of holding a hearing to allow relator's attorney an opportunity to join in relator's motion to suppress. Lower courts are required to accept and consider pro se filings from represented defendants in a preverdict context whenever doing so will not lead to confusion at trial. State v. Melon, 95-2209 (La. 9/22/95), 660 So.2d 466, 467. With respect to the petition for a writ of habeas corpus, the writ application is denied.
