For the reasons assigned in State v. Smith, 99-0606 (La. 7/6/00), 766 So.2d 501, regarding La.R.S. 14:89(A)(2), the ruling of the district court is reversed and the matter is remanded for further proceedings.

REVERSED AND REMANDED.
