STATE OF LOUISIANA v. MELVIN W. SMITH


In Re: Melvin W. Smith, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 03-14-0349.

BEFORE: WHIPPLE, C.J., WELCH AND CRAIN, JJ.

WRIT DENIED. We are informed by the office of the Clerk of Court of East Baton Rouge Parish that there is no record of a Petition for Writ of Habeas Corpus. However, relator has been billed and arraigned for the charge arising from his February 5, 2014 arrest. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So. 2d 45 (La. 1989) (per curiam). Further, we are advised by the judge's office that the district court is proceeding toward disposition of relator's Motion for Discovery and Inspection which was attached to our not mentioned in relator's writ aoolication.
