In re: Kevin Michael Shea Applying for Motion to Remand, 1st Judicial District Court, Caddo Parish, Nos. 111,684; 111,684-A.


The motion to remand the cases is granted. The ruling of the court below on the motion to suppress the confession is reversed and the confession is suppressed. The conviction is reversed and the cases are remanded for new trials.

DENNIS, J., dissents and would docket the case in this Court and permit the parties to present oral and written argument before deciding whether the U.S. Supreme Court's decision, ___ U.S. ___, 105 S.Ct. 1065, 84 L.Ed.2d 38, reversing 421 So.2d 200, requires reversal or affirmance of either conviction.

LEMMON, J., dissents from the decision rendered without briefing and argument on the harmless error issue.
