STATE OF LOUISIANA v. MALIK SHABAZZ


In Re: Malik Shabazz, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 08-10-0425.

BEFORE: PETTIGREW, THERIOT AND DRAKE, JJ.

WRIT DENIED ON THE SHOWING MADE. REQUEST FOR APPELLATE RECORD DENIED. Relator failed to include a copy of the pleadings on which the rulings were founded, the trial court's rulings, pertinent court minutes, and a copy of the opposition to the pleadings (or a statement that no opposing written document was filed). Furthermore, relator's request for the appellate record is premature, and there has been no undue delay in the trial court's consideration of relator's motion to appeal. See La. Code Crim. P. arts. 916 & 917. Supplementation of this writ application and/or an application for rehearing will not be considered. See Uniform Rules of Louisiana Courts of Appeal, Rules 2-18.7 & 4-9. Any future filing on this issue should include the entire contents of this application, the missing items noted above, and a copy of this ruling. In the event relator elects to file a new application with this Court, the application shall be filed on or before September 25, 2013.
