State v. Ruvolo

District Court of Appeal of Florida, Fourth District
Nov 2, 1983
439 So. 2d 1045 (Fla. Dist. Ct. App. 1983)

Opinion

No. 83-439.

November 2, 1983.

Appeal from Circuit Court, Palm Beach County; Marvin U. Mounts, Jr., Judge.

Jim Smith, Atty. Gen., Tallahassee, and Sharon Lee Stedman, Asst. Atty. Gen., West Palm Beach, for appellant.

Richard L. Jorandby, Public Defender, and Louis G. Carres, Asst. Public Defender, West Palm Beach, for appellee.

We find the allegations contained in the information charging appellee with burglary sufficient to meet the standard set forth in State v. Waters, 436 So.2d 66 (Fla. 1983). We recognize that the Supreme Court had not issued its opinion at the time the trial court dismissed the information.

REVERSED and REMANDED.

BERANEK, DELL and WALDEN, JJ., concur.
