Crichton, J., would grant and assigns reasons. I would grant the State's writ for reasons assigned by Judge Lobrano's dissent in the court of appeal. In my view, the trial court did not abuse its discretion when it denied relief summarily based upon its review of the pleadings. See La. C.Cr.P. art. 929(A).
