September 11, 2007.

Application by the appellant for a writ of error coram nobis to vacate, on the ground of ineffective assistance of appellate counsel, a decision and order of this Court dated March 14, 2006 ( see People v Rodriguez, 27 AD3d 585), determining an appeal from a judgment of the Supreme Court, Suffolk County, rendered December 1, 2003.

Before: Mastro, J.P., Santucci, Krausman and Skelos, JJ., concur.


Ordered that the application is denied.

The appellant has failed to establish that he was denied the effective assistance of appellate counsel ( see Jones v Barnes, 463 US 745; People v Stultz, 2 NY3d 277).
