STATE OF LOUISIANA v. BRENNAN RITCHIE


In Re; State of Louisiana, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 03-13-0564.

BEFORE: WHIPPLE, C.J., WELCH AND CRAIN, JJ.

WRIT GRANTED. The trial court abused its discretion in granting defendant's motion to quash. "We conclude the defendant failed to make a showing of specific prejudice to his defense which would warrant the granting of the motion to quash. See State v. King, 2010-2638 (La. 5/6/11), 60 So.3d 615 (per curiam). Accordingly, the ruling of the trial court granting the motion to quash filed by defendant Brennan Ritchie is reversed. The matter is remanded to the trial court for further proceedings.
