Opinion

Case No. SC01-295.

May 13, 2004.

Lower Tribunal No. 4D00-3129.

Upon review of petitioner's response to this Court's order to show cause dated February 27, 2003, the Court has determined that it should decline to exercise jurisdiction in this case. See State v. Klayman, 835 So.2d 248 (Fla. 2002). The petition for discretionary review is, therefore, denied.

No motion for rehearing will be entertained by the Court. See Fla. R. App. P. 9.330(d).

ANSTEAD, C.J., and PARIENTE, LEWIS and BELL, JJ., concur.

WELLS, J., dissents.
