ORDER

The Court having determined that the appeal raises an issue of public importance that is capable of repetition yet evades review, it is ORDERED that the motion to dismiss is denied; and it is further

ORDERED that, with the agreement of defendant and the State, the trial court is authorized to proceed with sentencing.
