STATE OF LOUISIANA v. FREDDIE PATTERSON


In Re: State of Louisiana, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 03-17-0045. BEFORE: McDONALD, CRAIN, AND HOLDRIDGE, JJ.

WRIT GRANTED. The district court's ruling granting the defendant's motion to suppress is reversed. The traffic stop was justified at its inception, as the officer's uncontroverted testimony established that the defendant failed to use a signal when the defendant moved his vehicle from the left lane to the right lane. See La. R.S. 32:104(D); State v. Guyn, 2016-1059 (La. App. 1st Cir. 4/12/17), 2017 WL 1376573, writ denied, 2017-1082 (La. 6/1/18), 243 So.3d 1062. Accordingly, this matter is remanded to the district court for further proceedings.
