MEMORANDUM OPINION


The Court has before it appellant The State of Texas's November 9, 2009 motion to dismiss its appeal. The State says it no longer desires to pursue the appeal and intends to comply with the trial court's order. We grant the motion and dismiss the appeal. See Tex. R. App. P. 42.1(a).
