STATE OF LOUISIANA v. LAVAR NELSON


In Re: Lavar Nelson, applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, No. 97-CR3-70793. BEFORE: HIGGINBOTHAM, HOLDRIDGE AND PENZATO, JJ.

WRIT GRANTED IN PART AND DENIED IN PART. The district court is ordered to proceed toward disposition of relator's "Motion to Correct an Illegal Sentence, Pursuant to LA. CR. C. P. Art. 882" on or before April 23, 2018, if it has not already done so. Furthermore, the records of the Washington Parish Clerk's Office reflect that the district court denied relator's "Motion for Leave of Court to File a Motion for a Valid Sentence Under Louisiana Code Criminal Procedure Article 872" on January 30, 2018. Accordingly, to the extent relator seeks mandamus relief from the district court's failure to rule on the "Motion for Leave of Court to File a Motion for a Valid Sentence Under Louisiana Code Criminal Procedure Article 872," the writ application is denied in part as moot.
