STATE OF LOUISIANA v. LAVAR NELSON


In Re: Lavar Nelson, applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, No. 97-CR3-70793. BEFORE: PETTIGREW, McDONALD, AND DRAKE, JJ.

WRIT GRANTED. The district court is instructed to proceed toward disposition of relator's "Motion for Leave of Court to File a Motion for a Valid Sentence Under Louisiana Code Criminal Procedure Article 872," filed August 24, 2015, if it has not already done so. The Clerk of Court of Washington Parish has no record of receiving a "Motion to Correct an Illegal Sentence, Pursuant to the LA. CR. C. P. Art. 882" (allegedly filed May 5, 2016) . The original of the writ application will be forwarded to the district court clerk of court for consideration of relator's "Motion to Correct an Illegal Sentence, Pursuant to the LA. CR. C. P. Art. 882."
