State v. Nay

Missouri Court of Appeals, Eastern District, Division Four
May 15, 2001
43 S.W.3d 905 (Mo. Ct. App. 2001)

Opinion

No. ED78212

Filed: May 15, 2001

APPEAL FROM THE CIRCUIT COURT OF PIKE COUNTY, HONORABLE FRED RUSH.

Mark Steven Fisher, 115 West Main Street, Bowling Green, MO 63334 for Respondent

Edward Rex Bradley, 2608 Georgia, Louisiana, MO 63353, for Appellant.

Before Lawrence E. Mooney, P.J., Paul J. Simon, J., and Sherri B. Sullivan, J.

ORDER

Defendant Blake A. Nay appeals from the judgment convicting him of one count of harassment in violation of section 565.090, RSMo 2000, challenging the sufficiency of the evidence. We have reviewed the briefs of the parties and the record on appeal and conclude the trial court did not plainly err. Rule 30.20. An extended opinion would have no precedential value. We have, however, provided a memorandum opinion for the use of the parties only setting forth the reasons for our decision. We affirm the judgment pursuant to Rule 30.25(b).

All rule references are to Mo. R. Crim. P. 2001, unless otherwise indicated.
