On April 9, 2008, this court announced its judgment in the above-captioned appeal. However, no formal judgment entry was signed and filed with the Clerk.
Accordingly, on consideration thereof, the certified question is answered in the affirmative and the judgment of the court of appeals is affirmed on the authority of Hyle v. Porter, 117 Ohio St.3d 165, 2008-Ohio-542, 882 N.E.2d 899.
It is ordered that for the purpose of filing a motion to reconsider this decision, or the filing of an appeal of this decision, the formal date of judgment shall be the date of the filing of this entry.
