05-21-2021
ORDER
This matter having initially come before the Court on the State's application for emergent relief (S-64-20), pursuant to Rule 2:9-8, seeking review of an order of the Superior Court, Appellate Division, filed April 29, 2021, which reversed the trial court's March 26, 2021 order and "remanded for the court to enter an order of pretrial release with appropriate monitoring conditions"; and
A single justice of the Court having granted the State's application and imposed a temporary stay pending the Court's consideration of the State's emergent motion for leave to appeal and for a stay; and
The Court having reviewed the parties' submissions and the record in this matter, including the parties' briefs to the Appellate Division and to the Supreme Court, and for good cause shown; it is
ORDERED that the State's motion for leave to appeal (M-1097-20) is granted, the order of the Appellate Division is summarily reversed, and the trial court's order is reinstated; and it is further
ORDERED that the State's motion for stay (M-1096-20) is dismissed as moot, and the temporary stay is vacated.
Jurisdiction is not retained.
