State v. Moore

The Court of Appeals of Washington, Division One
Feb 22, 2011
160 Wn. App. 1011 (Wash. Ct. App. 2011)

Opinion

No. 64756-3-I.

Filed: February 22, 2011.

Domanique Moore appeals from the judgment and sentence entered after he pleaded guilty to one count of first degree murder while armed with a firearm and one count of second degree assault. He contends that the trial court erroneously determined that he had committed a "sex offense" and then imposed a 36-month term of community custody based on that designation.

After reviewing the record, we accept the State's concession that Moore's murder conviction constituted a serious violent offense rather than a sex offense. See former RCW 9.94A.030(45), (46). Accordingly, we remand the matter for correction of the judgment and sentence and imposition of the appropriate term of community custody.

Remanded.
