STATE OF LOUISIANA v. JILL MILLER


In Re: Jill Miller, applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, No. 98-273280.

BEFORE: WHIPPLE, C.J., WELCH AND CRAIN, JJ.

WRIT DENIED. The instant application for post-conviction relief was filed untimely and relator's allegations do not support application of the facts-not-known exception. See La. Code Grim. P. art. 930.8(A)(1). Moreover, the United States Supreme Court's holding in Martinez v. Ryan, ___ U.S. ___, 132 S.Ct. 1309, 182 L.Ed.2d 272 (2012) does not create any right enforceable in state criminal post-conviction proceedings.
