Opinion

The Court in this case charged the jury that "to constitute manslaughter the stroke must be given with an intention of doing the deceased a bodily injury, or at least it must be inflicted with an unreasonable degree of force, and such as might very possibly cause the death of the person struck, or materially injure him."

On this charge, the defendant, who had been indicted for manslaughter in killing one Bishop, was acquitted.
