STATE OF LOUISIANA v. RAYNARDO MASON


In Re: Raynardo Mason, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 06-18-0164. BEFORE: MCDONALD, CRAIN, AND HOLDRIDGE, JJ.

WRIT DENIED. On June 7, 2018, the State charged relator by bill of information with the offenses at issue in his motions. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam). A motion for speedy trial must be accompanied by an affidavit certifying that the defendant and counsel are prepared to proceed to trial within the time delays. See La. Code Crim. P. art. 701(D)(1), The record before us contains no evidence that a motion and affidavit have been filed with the district court.
