STATE OF LOUISIANA v. TERRY MARTIN


In Re: Terry Martin, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 02-16-0663. BEFORE: GUIDRY, HOLDRIDGE, AND CHUTZ, JJ.

WRIT DENIED. The record of the Clerk of Court of East Baton Rouge Parish reflects that relator has been billed and arraigned for the charge at issue in his petition for a writ of habeas corpus. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam). Further, the record reflects the district court is proceeding toward disposition of relator's Motion for Release of Bond Obligation and Motion to Quash, which were attached to relator's writ application but not addressed, as there is a motion hearing scheduled for May 18, 2016.
