       PER CURIAM.

       Eldon Harold Manser was indicted for the crime of larceny in the nighttime as defined in section 709.4, Code, 1962. He entered a plea of not guilty, was tried, found guilty by the jury and the value of the property stolen was found to be in excess of $20. Defendant was sentenced to an indeterminate term not exceeding ten years in the Men's Reformatory at Anamosa as provided by said section. Defendant has appealed and has elected to submit his appeal on a clerk's transcript which reveals no error.

       Affirmed.
