State v. Lewis

Supreme Court of Louisiana
Nov 23, 1977
352 So. 2d 236 (La. 1977)

Opinion

No. 60817.

November 23, 1977.

IN RE: SAWYER LEWIS APPLYING FOR WRITS OF CERTIORARI, MANDAMUS AND PROHIBITION.

Writ denied. We cannot say the ruling was incorrect.

TATE, J., is of the opinion the writ should be granted.

DENNIS, J., is of the opinion the writ should be granted. In view of the facts that the defendant was faced with a life sentence, without parole etc., which he subsequently received, and that the state's case was based upon an apparent illegal seizure which the defendant's attorney failed to move to suppress, the defendant was denied effective assistance of counsel.
