State v. Lewis

Supreme Court of Louisiana
Jul 17, 1973
280 So. 2d 223 (La. 1973)

Opinion

No. 53751.

July 17, 1973.

IN RE: DONALD L. LEWIS AND WALTER J. LUCAS APPLYING FOR WRIT OF PROHIBITION.

Writ denied. The showing made does not warrant the exercise of this Court's supervisory jurisdiction.

TATE, J., concurs in the denial on the ground stated (which is partly based upon the absence of evidence under a formal bill of exceptions) at this time, being of the opinion that such denial is without prejudice to the relator to re-urge this condition upon appeal in the event of conviction.
