APPEAL FROM THE FIRST CIRCUIT COURT (CR. NO. 01-1-0861)

MOON, C.J., LEVINSON, NAKAYAMA, RAMIL, and ACOBA, JJ.

ORDER DISMISSING APPEAL

Upon review of the record, it appears that the appeal of the circuit court's decision continuing trial is an appeal of an interlocutory decision that was not certified for interlocutory appeal under HRS § 641-17. Thus, we lack jurisdiction over this appeal. Therefore,

IT IS HEREBY ORDERED that this appeal is dismissed for lack of appellate jurisdiction.
