STATE OF LOUISIANA v. RICHARD LAY


In Re: Richard Lay, applying for supervisory writs, 22nd Judicial District Court, Parish of Washington, No. 11-CR5-112033. BEFORE: WELCH, CRAIN, AND HOLDRIDGE, JJ.

WRIT GRANTED IN PART AND DENIED IN PART. Relator's writ application is granted in part for the sole purpose of transferring it to the district court for consideration of the merits of relator's application for postconviction relief, if it has not already done so. It appears that on August 12, 2016, the trial court set aside its March 29, 2016, ruling on relator's postconviction relief application. However, it is not clear if the trial court has since ruled on the merits of the application. The remainder of relator's application, in particular his claims regarding the denial of his motion to recuse, is denied.
