STATE OF LOUISIANA v. BYRON R. JONES


In Re: Byron R. Jones, applying for supervisory writs, 22nd Judicial District Court, Parish of St. Tammany, No. 487130.

BEFORE: KUHN, PETTIGREW, AND McDONALD, JJ.

WRIT GRANTED for the purpose of transferring the writ application to the district court for enforcement and clarification of its order of November 26, 2012, in which it granted relator's "motion for an out of time appeal by application for postconviction relief" and set February 11, 2013 as the return date for the appeal. The trial court also should appoint appellate counsel if appropriate. We note this Court dismissed relator's earlier appeal as untimely, noting the defendant could seek an out-of-time appeal by application for postconviction relief. 2011 KA 0478 (La. App. 1st Cir. 5/6/11).
