State v. Hunt

District Court of Appeal of Florida, Fourth District
Feb 9, 2000
765 So. 2d 57 (Fla. Dist. Ct. App. 2000)

Opinion

No. 4D99-0735

Opinion filed February 9, 2000 JANUARY TERM 2000

Appeal of a non-final order from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Ana I. Gardiner, Judge; L.T. No. 98-12683CF10A.

Robert A. Butterworth, Attorney General, Tallahassee, and Marrett W. Hanna, Assistant Attorney General, West Palm Beach, for appellant.

Thomas E. Cazel, Fort Lauderdale, for appellee.

We affirm the order of the trial court suppressing cocaine seized from appellee. The state's argument is premised on the testimony of the officers. That testimony was contradicted by appellee. Appellee's version of events fully supports the trial court's ruling.

WARNER, C.J., FARMER and TAYLOR, JJ., concur.
