ORDER OF ABATEMENT

PER CURIAM

On May 2, 2024, this matter was reinstated following the submission of supplemental clerk's records and reporter's records addressing the completion of the retrospective competency evaluation performed as previously ordered by this Court. Having reviewed the supplemental records and the parties' previously filed briefs, this Court observes that the underlying issues previously presented to this Court may be affected by the trial court's completion of the retrospective competency hearing. Accordingly, we hereby ORDER the parties to file supplemental briefs addressing this issue. See Tex. R. App. P. 38.7. The briefs shall specifically address the effect that the supplemental records and facts and findings of the trial court have on the pending appeal.

The State shall file its supplemental brief within thirty (30) days from the date of this order. Appellee shall file his responsive supplemental brief, if any, within thirty (30) days from the date the State's supplemental brief is filed. This appeal is ABATED and removed from the Court's active docket until receipt of the requested briefing or until further order of this Court.
