The trial court properly denied appellant's motion to suppress, Chambers v. Moroney, 399 U.S. 42, 26 L Ed 2d 419, 90 S Ct 1975 (1970), and State v. Pennington, 28 Or. App. 331, 559 P.2d 915, Sup Ct review denied (1977), and for a new trial, State v. Hancock, 247 Or. 21, 426 P.2d 872 (1967), and State v. Arndt, 1 Or. App. 608, 465 P.2d 486 (1970).

Affirmed.
