MOTION AND PROCEDURAL RULINGS
It is ordered by the court, sua sponte, that this cause is no longer held for the decision in State v. Cabrales, 118, Ohio St.3d 54, 2008-Ohio-1625, 886 N.E.2d 181, and briefing shall proceed on Proposition of Law No. I.
It is further ordered that the Clerk shall issue an order for the transmittal of the record from the Court of Appeals for Hamilton County, and the parties shall brief this case in accordance with S.Ct.Prac. R. VI.
