STATE OF LOUISIANA v. HOWARD GROSS


In Re: Howard Gross, applying for supervisory writs, 19th Judicial District Court, Parish of East Baton Rouge, No. 12-14-0450. BEFORE: PETTIGREW, DRAKE, AND CHUTZ, JJ.

WRIT DENIED. The record of the Clerk of Court of East Baton Rouge Parish reflects that relator has been billed for the charge at issue in his petition for a writ of habeas corpus. Therefore, a request for release under La. Code Crim. P. art. 701(B) is moot. See State v. Varmall, 539 So.2d 45 (La. 1989) (per curiam). Further, the district court is proceeding toward disposition on relator's Motion to Quash, as it is set for hearing on May 25, 2015.
